Digit Run Studio highly respects your personal information and data, and will make every effort to ensure the security and reliability of your personal information and data. This policy applies only to user information and data collected and stored by Photo Memory.

Please carefully read, understand, and agree to the Photo Memory Privacy Policy before using Photo Memory. This policy sets forth how we will collect, use, disclose, process, and protect the information you provide to us when using Photo Memory. If we need you to provide certain information to verify your identity when using this product, or when connecting to services from our third-party service providers, we will strictly follow this privacy policy in using such information. If you have already started using Photo Memory, it means that you have read, authorized, and accept all the terms described in this privacy policy, as well as any changes we may make at any time in the future.

Additionally, you must confirm that you are an adult when you start using this product. If you are a minor, your guardian must consent to your use of this product and agree to the relevant terms of service and privacy policy.

1. Information Collection and Use

1.1 Basic Information Collection

Registration Information

Phone number: Used for account registration, identity verification, and account security protection
Device information: Hardware model, operating system version, device configuration, unique device identifier, device connection information, device status information, network identity information, and application list
Advertising identifier IDFA: Collected only on iOS versions below 14.5, used for personalized advertising recommendations

Please understand that this information is essential for us to provide services and ensure the normal operation of our products.

1.2 Permission Requests

1.2.1 Read Device Information

The device ID will be used as the account identifier, allowing users to enjoy basic services without registration.

1.2.2 Read/Write External Storage Permission

This permission is required when you use camera capture, photo album import, or save to local album features. If you do not enable this permission, you will be unable to use storage-related features, but other services will not be affected.

1.2.3 Camera Permission

Camera permission is required for AI image processing features to enable real-time photography. If this permission is not enabled, you will be unable to use photography-related features, but other services will not be affected.

1.2.4 Network Permission

Network permission is required when using AI image processing features to upload to servers and obtain processing results.

1.3 AI Content Generation Services

Based on artificial intelligence model technology, we provide you with AI content generation services (image, audio, and video generation). To provide these services, we collect text, images, audio, video, and other content and instructions that you actively select or input. We analyze the above information to better generate content that meets your instructions and requirements.

After being processed with secure encryption technology, strictly de-identified and unable to re-identify specific individuals, we may use the collected data and corresponding model-generated content for model optimization.

1.4 Third-Party AI Service Providers

Important Notice: To deliver high-quality AI-powered features, your photos and related data may be securely transmitted to the following trusted third-party AI service providers for processing:

TikTok — Utilized for advanced AI image processing and enhancement
Doubao — Utilized for intelligent AI content generation

We ensure that all data shared with these providers is handled in strict accordance with this Privacy Policy and applicable data protection regulations. These providers are contractually obligated to process your data solely for the purposes described above and are prohibited from using it for any other purpose.

1.5 Collection and Processing of Facial Data

Important Notice: Given that facial data constitutes personal sensitive information, we apply the highest level of security protection measures for the processing of facial data.

1.5.1 Types of Facial Data

We may collect the following types of face-related data:

Image files containing faces actively uploaded by users
Face position and basic geometric feature information detected through the iOS Core Image framework
Artworks containing faces generated after AI processing
Operation logs for face detection and processing (excluding specific image content)

1.5.2 Purposes of Facial Data Use

We collect and process facial data solely for the following explicit purposes:

Photo Restore: Restoring old photos containing faces and improving quality
Time Painting: Generating smiles, greetings, etc. based on user faces
AI Edit: Changing hairstyles, clothing, backgrounds, etc. in user photos
Photo Enlarge: Increasing the resolution of user photos
Erase Pen: Removing blemishes and creases from facial photos
Face Detection Verification: Ensuring uploaded images contain faces and are suitable for AI processing features

1.5.3 Technical Processing Methods for Facial Data

Face detection is performed locally on the device using the Core Image framework provided by Apple
Facial images are transmitted in Base64 encoding format via HTTPS encryption to AI processing servers
End-to-end encryption is used to ensure data security during transmission
We do not extract or store biometric templates for identity verification or surveillance purposes
All facial data processing is limited to AI art creation features actively requested by you

1.5.4 Storage Location and Duration of Facial Data

Local device storage: Your facial images are temporarily stored in the application sandbox on your device, and you can delete them at any time through the in-app history management feature
Server temporary processing: Facial images are uploaded to our AI processing servers for algorithmic processing, and original images are automatically deleted within 24 hours after processing is completed
User artwork storage: User-generated artworks are retained in the user's personal account, and you can delete them at any time
Temporary cache files: Temporary files generated during processing are cleared immediately after processing is completed
Operation logs: Operation logs for face detection and processing are automatically deleted after 7 days

1.5.5 Third-Party Sharing Policy for Facial Data

We commit to:

Never sell: We will not sell your facial data to any third-party company or individual
Never use for advertising: We will not use facial data for advertising, user profiling, or marketing purposes
Never share with marketing companies: We will not share facial data with data brokers, marketing companies, or advertising companies
Technical service providers: Technical service providers may only be involved in the following circumstances:
- Alibaba Cloud OSS storage service: Used only as cloud storage infrastructure with encrypted storage; the service provider cannot access specific image content
- Our own AI processing servers: Access is strictly limited and used only for image algorithm processing, not for other purposes

1.5.6 User Control over Facial Data

You have the following rights:

Right to Know: Understand the specific processing methods, purposes, and scope of facial data
Right to Consent: Withdraw consent for facial data processing at any time and stop using related features
Right to Access: View the processing records and status of your facial data that we maintain
Right to Deletion: Request deletion of all related facial data on devices and servers
Right to Correction: Request correction or reprocessing if errors are found in facial data processing
Right to Data Export: Request export of a copy of your facial data
Right to Restrict Processing: Request that we stop certain specific facial data processing activities

2. Information Use Principles

Photo Memory will not provide, sell, rent, share, or trade your personal information to any unrelated third party, unless your prior permission has been obtained, or the third party and Photo Memory provide services to you individually or jointly, and after such services end, the third party will be prohibited from accessing all such information, including information it was previously able to access.

Photo Memory also does not allow any third party to collect, edit, sell, or freely distribute your personal information by any means. If any Photo Memory platform user engages in the above activities, once discovered, Photo Memory has the right to immediately terminate the service agreement with that user.

For the purpose of serving users, Photo Memory may use your personal information to provide you with information of interest, including but not limited to sending you product and service information, or sharing information with Photo Memory partners so they can send you information about their products and services (the latter requires your prior consent).

3. Information Disclosure

Photo Memory will disclose your personal information in whole or in part based on your personal wishes or legal requirements in the following circumstances:

Disclosure to third parties with your prior consent
Sharing your personal information with third parties as necessary to provide the products and services you have requested
Disclosure to third parties or administrative/judicial authorities in accordance with relevant legal provisions or at the request of administrative or judicial authorities
Disclosure to third parties if you violate relevant Chinese laws, regulations, or Photo Memory service agreements or related rules
If you are a qualified intellectual property complainant and have filed a complaint, disclosure to the respondent at their request to facilitate both parties in handling potential rights disputes
Other disclosures that Photo Memory deems appropriate based on laws, regulations, or website policies

Special Note: For facial data, unless explicitly required by laws and regulations, we will not disclose your facial images under the above circumstances, and will only provide necessary non-sensitive information.

4. Information Security

4.1 General Security Measures

Photo Memory accounts have security protection features. Please keep your username and password information safe. Photo Memory will ensure that your information is not lost, misused, or altered through security measures such as encrypting user passwords.

4.2 Special Security Protection Measures for Facial Data

Given the sensitivity of facial data, we adopt the following special security protection measures:

Transmission security: All facial data transmissions use TLS 1.3 encryption protocol
Storage security: AES-256 encryption algorithm is used to protect data at rest
Access control: Access to facial data is strictly limited, with only authorized technical personnel having access when necessary
Audit logs: All access and processing operations on facial data are recorded, establishing a complete audit trail
Regular deletion: Automated systems are established to ensure timely deletion of expired data
Security assessments: Regular security risk assessments and vulnerability scans for facial data processing

You have the right to choose to accept or refuse cookies. You can refuse cookies by modifying your browser settings. However, if you choose to refuse cookies, you may be unable to log in to or use Photo Memory network services or features that rely on cookies.

Information obtained through cookies set by Photo Memory will be subject to this policy.

6. Account Deletion

If you need to delete your account, please follow these steps:

Open the app
Tap to enter the "Me" page
Tap "Settings"
Tap "Delete Account"

Important Notice: After tapping delete, all your information stored on the server (including account, membership information, facial data, generated artworks, etc.) will be permanently deleted immediately and cannot be recovered. Please proceed with caution.

7. Data Retention Policy and Storage

7.1 Data Retention Principles

We will retain the personal information collected above for the period required by laws and regulations and necessary to fulfill the purposes of information collection. After the above period, we will no longer retain personal information or will anonymize personal information.

7.2 Data Storage Location

Personal information collected and generated through this product and services will be stored within the territory of the People's Republic of China.

7.3 Specific Data Storage Periods

For different types of data, we adopt the following specific retention periods:

General user data: The time required to fulfill service purposes, typically no more than 6 months
Face-related data:
- Original facial images: Automatically deleted within 24 hours after AI processing is completed
- Generated artworks: Retained in the user's account, users can delete at any time
- Face detection operation logs: Automatically deleted after 7 days
- Face processing temporary files: Deleted immediately after processing is completed
Technical data such as device identifiers: Anonymized after 6 months
User feedback and customer service records: Deleted after 3 years

If our products or services cease operations, we will notify you through push notifications, announcements, and other means, and will delete your personal information or anonymize it within a reasonable period.
